大學畢業生求職應把握七大政策要點

問題一(yi):誰受《勞動合(he)同法(fa)》的規范和保(bao)護?

  大學畢業生有各(ge)種各(ge)樣的(de)求職(zhi)愿望(wang),有的(de)希(xi)望(wang)進入公務員隊伍,有的(de)希(xi)望(wang)進入事(shi)業單(dan)位(wei)和社會團體,也有的(de)想進入企業或者自己創業。

  在這種情況下,大學畢業生在學習和掌握《勞動合同法》時,首先要了解《勞動合同法》的適用范圍。
 
 
 

  與1995年(nian)實施的《勞(lao)(lao)動(dong)(dong)法(fa)》相(xiang)比,《勞(lao)(lao)動(dong)(dong)合(he)(he)同法(fa)》適當擴大了適用范圍。除了企業(ye)(ye)、個(ge)體經(jing)濟(ji)組織(zhi)以外,一是將民辦非(fei)企業(ye)(ye)納入到《勞(lao)(lao)動(dong)(dong)合(he)(he)同法(fa)》的調(diao)整范圍,所謂民辦非(fei)企業(ye)(ye)單位是企業(ye)(ye)、事業(ye)(ye)單位、社(she)(she)會(hui)團體和其他(ta)社(she)(she)會(hui)力(li)量以及公民個(ge)人利用非(fei)國有(you)資(zi)產舉(ju)辦的,從事非(fei)營利性社(she)(she)會(hui)服務活動(dong)(dong)的社(she)(she)會(hui)組織(zhi)。如民辦學校、民辦醫院、民辦圖書館、民辦博物館、民辦科技館等。

  二是(shi)對(dui)(dui)事業(ye)單(dan)(dan)位與實行(xing)(xing)聘用(yong)制的(de)(de)(de)(de)(de)人員(yuan)是(shi)否(fou)適(shi)用(yong)作(zuo)(zuo)了(le)靈活規(gui)(gui)定(ding),即法(fa)(fa)律、行(xing)(xing)政法(fa)(fa)規(gui)(gui)或者國(guo)務(wu)院(yuan)另有規(gui)(gui)定(ding)的(de)(de)(de)(de)(de),依照(zhao)其(qi)規(gui)(gui)定(ding);未作(zuo)(zuo)規(gui)(gui)定(ding)的(de)(de)(de)(de)(de),依照(zhao)《勞動(dong)(dong)合(he)同(tong)法(fa)(fa)》的(de)(de)(de)(de)(de)規(gui)(gui)定(ding)執(zhi)行(xing)(xing)。三是(shi)規(gui)(gui)定(ding)國(guo)家機(ji)關、事業(ye)單(dan)(dan)位、社會(hui)團(tuan)體和其(qi)建立(li)勞動(dong)(dong)關系的(de)(de)(de)(de)(de)勞動(dong)(dong)者,也就是(shi)除公(gong)務(wu)員(yuan)和參照(zhao)公(gong)務(wu)員(yuan)法(fa)(fa)管理的(de)(de)(de)(de)(de)人員(yuan),以及事業(ye)單(dan)(dan)位中實行(xing)(xing)聘用(yong)制的(de)(de)(de)(de)(de)工(gong)作(zuo)(zuo)人員(yuan)外,依照(zhao)《勞動(dong)(dong)合(he)同(tong)法(fa)(fa)》執(zhi)行(xing)(xing)。四是(shi)對(dui)(dui)勞務(wu)派遣用(yong)工(gong)作(zuo)(zuo)了(le)專門(men)的(de)(de)(de)(de)(de)規(gui)(gui)定(ding)。因(yin)此,如果大學畢業(ye)生(sheng)選擇了(le)《勞動(dong)(dong)合(he)同(tong)法(fa)(fa)》適(shi)用(yong)范圍(wei)內的(de)(de)(de)(de)(de)組織(zhi)(用(yong)人單(dan)(dan)位)就業(ye),就會(hui)受(shou)到(dao)《勞動(dong)(dong)合(he)同(tong)法(fa)(fa)》的(de)(de)(de)(de)(de)規(gui)(gui)范和保護。

  問題二:用人(ren)單位招用人(ren)員時(shi),應當依法如實告(gao)知(zhi)勞(lao)動者哪些情況?

  在求職就業過程中,不(bu)(bu)少大學生都曾遇到(dao)過這種(zhong)情況,一(yi)些用人單位故意隱瞞真(zhen)實的(de)工作信(xin)息,或者將工作條件(jian)和勞動報酬說(shuo)得天花(hua)亂墜,到(dao)實際工作時完全不(bu)(bu)是這么回事,這往往使畢業生大失所望,給(gei)其職業生涯帶來(lai)負面影(ying)響。

  鑒于現實(shi)(shi)生(sheng)活中的(de)這種情況(kuang),《勞(lao)(lao)動合同法》第(di)八(ba)條規定,“用(yong)(yong)人單(dan)(dan)位(wei)招用(yong)(yong)勞(lao)(lao)動者(zhe)時(shi),應當如實(shi)(shi)告知勞(lao)(lao)動者(zhe)工作(zuo)內容、工作(zuo)條件、工作(zuo)地點、職業(ye)(ye)危害、安全生(sheng)產(chan)狀況(kuang)、勞(lao)(lao)動報酬(chou),以及勞(lao)(lao)動者(zhe)要求了解(jie)的(de)其他情況(kuang)”。也(ye)就是說(shuo),在應聘時(shi),大(da)學畢業(ye)(ye)生(sheng)有權了解(jie)用(yong)(yong)人單(dan)(dan)位(wei)的(de)基本情況(kuang)、自己的(de)工作(zuo)內容和勞(lao)(lao)動報酬(chou)等;此(ci)外,用(yong)(yong)人單(dan)(dan)位(wei)還應當根據(ju)勞(lao)(lao)動者(zhe)的(de)要求,及時(shi)向其反饋(kui)是否錄用(yong)(yong)的(de)情況(kuang)。

  問題三:勞動者可否拒絕作答與勞動合同無關(guan)的(de)個(ge)人情況?

  為了尊重公民的基(ji)本(ben)(ben)權(quan)(quan)利,保護(hu)勞動(dong)者(zhe)(zhe)的隱私權(quan)(quan),《勞動(dong)合同法》第八(ba)條明(ming)確規定:“用人單(dan)(dan)位(wei)(wei)招用勞動(dong)者(zhe)(zhe)時,用人單(dan)(dan)位(wei)(wei)有(you)權(quan)(quan)了解勞動(dong)者(zhe)(zhe)與(yu)勞動(dong)合同直(zhi)接相關(guan)(guan)的基(ji)本(ben)(ben)情況(kuang),勞動(dong)者(zhe)(zhe)應當如實說明(ming)。”換句話說,不屬(shu)于“與(yu)勞動(dong)合同直(zhi)接相關(guan)(guan)的基(ji)本(ben)(ben)情況(kuang)”,用人單(dan)(dan)位(wei)(wei)都(dou)無權(quan)(quan)過問,勞動(dong)者(zhe)(zhe)也有(you)權(quan)(quan)拒絕(jue)作答。

  2008年1月1日起開(kai)始(shi)施(shi)行(xing)的(de)《就(jiu)業服務與(yu)就(jiu)業管理(li)規(gui)定(ding)》第十(shi)六條也(ye)規(gui)定(ding),用(yong)(yong)人(ren)單位(wei)在招用(yong)(yong)人(ren)員(yuan)時,除國(guo)家規(gui)定(ding)的(de)不適合婦(fu)(fu)女從事的(de)工種(zhong)或者(zhe)(zhe)崗位(wei)外,不得以性(xing)別(bie)為由拒絕(jue)錄(lu)用(yong)(yong)婦(fu)(fu)女或者(zhe)(zhe)提高對婦(fu)(fu)女的(de)錄(lu)用(yong)(yong)標(biao)準。用(yong)(yong)人(ren)單位(wei)錄(lu)用(yong)(yong)女職(zhi)(zhi)工,不得在勞動合同中規(gui)定(ding)限制女職(zhi)(zhi)工結婚、生育的(de)內容(rong)。

  另外,如果(guo)用(yong)人(ren)單位(wei)(wei)強(qiang)查乙肝(gan)血清學指(zhi)標(biao)將(jiang)要承擔法律(lv)(lv)責任(ren)(ren)。也就是(shi)說(shuo),用(yong)人(ren)單位(wei)(wei)違反(fan)《就業服務與就業管(guan)理規(gui)定(ding)》第十(shi)九條第二款規(gui)定(ding),在國家(jia)法律(lv)(lv)、行(xing)政法規(gui)和國務院衛生行(xing)政部(bu)門(men)規(gui)定(ding)禁(jin)止乙肝(gan)病原攜帶者從事的(de)工作崗位(wei)(wei)以(yi)外招用(yong)人(ren)員時,將(jiang)乙肝(gan)病毒血清學指(zhi)標(biao)作為體檢標(biao)準的(de),由勞動(dong)保障(zhang)行(xing)政部(bu)門(men)責令(ling)改(gai)正(zheng),并可處(chu)以(yi)一千(qian)元以(yi)下(xia)的(de)罰款;對當事人(ren)造成損害的(de),應當承擔賠償責任(ren)(ren)。

  問題四:用人單位能否要求求職者提供擔(dan)保或(huo)向其收取財物?

  少數用(yong)(yong)人(ren)單(dan)(dan)(dan)位(wei)為謀取錢財,采用(yong)(yong)招聘途徑,通過向求(qiu)職(zhi)者收取招聘費、培(pei)訓費、押(ya)金或服裝費等,獲取不(bu)(bu)當(dang)得(de)利(li)。一些畢(bi)業(ye)生求(qiu)職(zhi)時(shi)會(hui)遇到這種情(qing)況,參(can)加(jia)面試(shi)時(shi),公司告(gao)知要參(can)加(jia)培(pei)訓,考試(shi)合格(ge)后方能錄(lu)用(yong)(yong),培(pei)訓費自付。但當(dang)培(pei)訓結束后,用(yong)(yong)人(ren)單(dan)(dan)(dan)位(wei)會(hui)以(yi)條(tiao)件不(bu)(bu)符、考試(shi)不(bu)(bu)合格(ge)等原因(yin)而不(bu)(bu)予(yu)錄(lu)用(yong)(yong)。或者用(yong)(yong)人(ren)單(dan)(dan)(dan)位(wei)稱會(hui)給予(yu)畢(bi)業(ye)生職(zhi)位(wei),但須(xu)繳(jiao)納(na)抵押(ya)金。大學畢(bi)業(ye)生急于得(de)到工(gong)作,輕易地交出錢財。而當(dang)勞(lao)動者提出辭職(zhi)時(shi),用(yong)(yong)人(ren)單(dan)(dan)(dan)位(wei)卻(que)拒絕(jue)退(tui)還抵押(ya)金。

  《勞(lao)(lao)動合同法》第九條規定(ding),用(yong)人單位(wei)招用(yong)勞(lao)(lao)動者(zhe)(zhe)(zhe),不(bu)得扣(kou)押(ya)勞(lao)(lao)動者(zhe)(zhe)(zhe)的居民身(shen)份(fen)證和其(qi)他證件,不(bu)得要(yao)求勞(lao)(lao)動者(zhe)(zhe)(zhe)提供擔保或者(zhe)(zhe)(zhe)以其(qi)他名義向勞(lao)(lao)動者(zhe)(zhe)(zhe)收(shou)取財物(wu)。該(gai)法加(jia)大了對(dui)扣(kou)押(ya)勞(lao)(lao)動者(zhe)(zhe)(zhe)的居民身(shen)份(fen)證和收(shou)取押(ya)金等行為的處罰力度。

  《勞(lao)動(dong)合同(tong)法(fa)》第八十四條規定,扣押勞(lao)動(dong)者居民(min)身份證等證件的,由勞(lao)動(dong)行政(zheng)部門(men)責令限(xian)期退(tui)還(huan)勞(lao)動(dong)者本人,并(bing)依照有關法(fa)律規定給(gei)以(yi)(yi)處罰(fa)。用(yong)人單位以(yi)(yi)擔保或者其(qi)他名義(yi)向(xiang)勞(lao)動(dong)者收取財物的,由勞(lao)動(dong)行政(zheng)部門(men)責令限(xian)期退(tui)還(huan)勞(lao)動(dong)者本人,并(bing)以(yi)(yi)每人五百(bai)元(yuan)以(yi)(yi)上兩千元(yuan)以(yi)(yi)下的標準處以(yi)(yi)罰(fa)款;給(gei)勞(lao)動(dong)者造成(cheng)損害(hai)的,應(ying)當承(cheng)擔賠償責任。

  問題五:建立勞動關系,應當注意(yi)哪些問題?

  鑒于用人單位(wei)不(bu)與(yu)勞(lao)(lao)動(dong)(dong)者(zhe)簽訂書(shu)(shu)面(mian)勞(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)(tong)的情況較為(wei)普遍,勞(lao)(lao)動(dong)(dong)者(zhe)的權益極易受到侵害,《勞(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)(tong)法(fa)》更(geng)加強調,“建立(li)勞(lao)(lao)動(dong)(dong)關(guan)系,應當(dang)訂立(li)書(shu)(shu)面(mian)勞(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)(tong)”。大學畢業生求(qiu)職就(jiu)業要特別注(zhu)意這一環節。與(yu)《勞(lao)(lao)動(dong)(dong)法(fa)》相比,《勞(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)(tong)法(fa)》強調了用人單位(wei)在訂立(li)書(shu)(shu)面(mian)勞(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)(tong)方(fang)面(mian)的義務(wu),并將這些義務(wu)具體化。

  第(di)(di)一(yi)(yi)(yi),勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)應當在(zai)建立勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)關系的(de)(de)一(yi)(yi)(yi)個月(yue)內訂(ding)立;第(di)(di)二(er),用(yong)人(ren)單位(wei)(wei)自用(yong)工(gong)之(zhi)日起超(chao)過(guo)一(yi)(yi)(yi)個月(yue)不滿一(yi)(yi)(yi)年未與(yu)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)(zhe)訂(ding)立書(shu)(shu)面(mian)(mian)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)的(de)(de),應當向(xiang)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)(zhe)每月(yue)支付兩倍的(de)(de)工(gong)資;第(di)(di)三(san),用(yong)人(ren)單位(wei)(wei)自用(yong)工(gong)之(zhi)日起滿一(yi)(yi)(yi)年不與(yu)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)(zhe)訂(ding)立書(shu)(shu)面(mian)(mian)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)的(de)(de),視為用(yong)人(ren)單位(wei)(wei)與(yu)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)(zhe)已訂(ding)立無固定(ding)期(qi)限勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong);第(di)(di)四,用(yong)人(ren)單位(wei)(wei)未在(zai)用(yong)工(gong)的(de)(de)同(tong)(tong)時訂(ding)立書(shu)(shu)面(mian)(mian)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong),與(yu)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)(zhe)約定(ding)的(de)(de)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)報酬(chou)不明確的(de)(de),新招用(yong)的(de)(de)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)(zhe)的(de)(de)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)報酬(chou)按(an)照集(ji)(ji)體合(he)(he)同(tong)(tong)規定(ding)的(de)(de)標準(zhun)執(zhi)行(xing);沒有集(ji)(ji)體合(he)(he)同(tong)(tong)或者(zhe)(zhe)(zhe)(zhe)集(ji)(ji)體合(he)(he)同(tong)(tong)未規定(ding)的(de)(de),實行(xing)同(tong)(tong)工(gong)同(tong)(tong)酬(chou);第(di)(di)五(wu),勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)由用(yong)人(ren)單位(wei)(wei)與(yu)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)(zhe)協(xie)商一(yi)(yi)(yi)致,并(bing)經(jing)用(yong)人(ren)單位(wei)(wei)與(yu)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)(zhe)(zhe)在(zai)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)文本上簽字或者(zhe)(zhe)(zhe)(zhe)蓋章生效。

  勞(lao)(lao)(lao)(lao)動(dong)(dong)合同文(wen)(wen)本用(yong)(yong)人(ren)單位(wei)和勞(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)各執一份。如(ru)果用(yong)(yong)人(ren)單位(wei)提供的勞(lao)(lao)(lao)(lao)動(dong)(dong)合同文(wen)(wen)本未載明必備條款,或(huo)者(zhe)用(yong)(yong)人(ren)單位(wei)未將勞(lao)(lao)(lao)(lao)動(dong)(dong)合同文(wen)(wen)本交付(fu)勞(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)的,由勞(lao)(lao)(lao)(lao)動(dong)(dong)行政部門(men)責(ze)令改(gai)正;給(gei)勞(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)造成損(sun)害的,應當承擔賠償責(ze)任。

  問題六:求職(zhi)者在試用期內,享(xiang)有哪(na)些權(quan)益?

  試用(yong)(yong)期是(shi)一個敏(min)感的(de)階段,應聘的(de)畢(bi)業(ye)生(sheng)雖已踏進用(yong)(yong)人單位(wei),但在成為正(zheng)式員(yuan)工前(qian)總惴(zhui)惴(zhui)不安,生(sheng)怕失去眼前(qian)的(de)工作,所以對用(yong)(yong)人單位(wei)總是(shi)百(bai)依百(bai)順(shun)答應一切要求(qiu)。一些用(yong)(yong)人單位(wei)也摸透(tou)了(le)畢(bi)業(ye)生(sheng)的(de)這種心理,借機(ji)牟取(qu)非法利益。用(yong)(yong)人單位(wei)的(de)做法主要有以下幾種。

  一(yi)是試用(yong)(yong)(yong)(yong)期(qi)(qi)(qi)不簽(qian)訂勞(lao)(lao)動合同。試用(yong)(yong)(yong)(yong)期(qi)(qi)(qi)原(yuan)本(ben)是用(yong)(yong)(yong)(yong)人單(dan)位與(yu)勞(lao)(lao)動者為(wei)相(xiang)互(hu)了解對方而(er)約定(ding)的(de)考察期(qi)(qi)(qi),然(ran)而(er)卻成了很多用(yong)(yong)(yong)(yong)人單(dan)位降低人工成本(ben)、使用(yong)(yong)(yong)(yong)廉(lian)價(jia)勞(lao)(lao)動力的(de)一(yi)個堂而(er)皇之(zhi)的(de)借口。部分(fen)用(yong)(yong)(yong)(yong)人單(dan)位在試用(yong)(yong)(yong)(yong)期(qi)(qi)(qi)不與(yu)畢業(ye)生簽(qian)訂勞(lao)(lao)動合同,在試用(yong)(yong)(yong)(yong)期(qi)(qi)(qi)滿后以各(ge)種(zhong)理(li)由辭退應聘(pin)者。這使應聘(pin)的(de)畢業(ye)生白白付出大(da)量時間精力,也錯(cuo)過最(zui)佳就業(ye)期(qi)(qi)(qi),造成很大(da)損失。

  針對此現象,《勞動(dong)(dong)合(he)同(tong)(tong)法》規定(ding),“建立勞動(dong)(dong)關(guan)系,應當訂立書面勞動(dong)(dong)合(he)同(tong)(tong)”。“勞動(dong)(dong)合(he)同(tong)(tong)期(qi)限(xian)三(san)個月(yue)以上不(bu)(bu)滿(man)一(yi)年的(de)(de),試用(yong)(yong)期(qi)不(bu)(bu)得(de)超過(guo)一(yi)個月(yue);勞動(dong)(dong)合(he)同(tong)(tong)期(qi)限(xian)一(yi)年以上不(bu)(bu)滿(man)三(san)年的(de)(de),試用(yong)(yong)期(qi)不(bu)(bu)得(de)超過(guo)兩(liang)個月(yue);三(san)年以上固定(ding)期(qi)限(xian)和無固定(ding)期(qi)限(xian)的(de)(de)勞動(dong)(dong)合(he)同(tong)(tong),試用(yong)(yong)期(qi)不(bu)(bu)得(de)超過(guo)六(liu)個月(yue)。同(tong)(tong)一(yi)用(yong)(yong)人單位與同(tong)(tong)一(yi)勞動(dong)(dong)者只(zhi)能約(yue)定(ding)一(yi)次試用(yong)(yong)期(qi)。”這些(xie)規定(ding),將會有效地約(yue)束用(yong)(yong)人單位濫用(yong)(yong)試用(yong)(yong)期(qi)的(de)(de)行為。

  二(er)是試(shi)用(yong)期內隨(sui)意(yi)解除勞(lao)動合(he)同。勞(lao)動者(zhe)勤勤懇懇地在用(yong)人單位工(gong)作(zuo)三(san)個月(yue),眼(yan)看試(shi)用(yong)期將滿,沒有收到(dao)轉正通(tong)知,卻得到(dao)因不(bu)符合(he)錄用(yong)條(tiao)件而被辭(ci)退(tui)的消息。這(zhe)種情況在畢業(ye)生就業(ye)時也十(shi)分多見,也是用(yong)人單位不(bu)合(he)法(fa)的用(yong)工(gong)方(fang)式。

  根據《勞(lao)動(dong)(dong)合(he)(he)同法(fa)(fa)》規定,勞(lao)動(dong)(dong)者在試用期間(jian)被證(zheng)(zheng)明不符合(he)(he)錄(lu)用條件(jian)的(de)(de),用人(ren)(ren)單(dan)位可以解(jie)除勞(lao)動(dong)(dong)合(he)(he)同,但(dan)這并不意(yi)味著用人(ren)(ren)單(dan)位可以在試用期內隨意(yi)辭退勞(lao)動(dong)(dong)者。用人(ren)(ren)單(dan)位可解(jie)除勞(lao)動(dong)(dong)合(he)(he)同的(de)(de)條件(jian)是(shi)必(bi)須舉(ju)證(zheng)(zheng)證(zheng)(zheng)明勞(lao)動(dong)(dong)者在試用期間(jian)不符合(he)(he)錄(lu)用條件(jian),如(ru)果用人(ren)(ren)單(dan)位沒有證(zheng)(zheng)據證(zheng)(zheng)明勞(lao)動(dong)(dong)者在試用期間(jian)不符合(he)(he)錄(lu)用條件(jian),就不能解(jie)除勞(lao)動(dong)(dong)合(he)(he)同。否則,需承擔因違(wei)法(fa)(fa)解(jie)除勞(lao)動(dong)(dong)合(he)(he)同所帶來的(de)(de)一切法(fa)(fa)律后(hou)果。

  三(san)是(shi)“試(shi)用(yong)期(qi)(qi)”等于(yu)(yu)“白用(yong)期(qi)(qi)”。以(yi)(yi)(yi)前很多(duo)畢(bi)業(ye)(ye)生(sheng)對勞(lao)動(dong)(dong)法(fa)律(lv)法(fa)規不(bu)了解(jie),以(yi)(yi)(yi)為試(shi)用(yong)期(qi)(qi)就應(ying)該拿低工(gong)(gong)資或者沒有勞(lao)動(dong)(dong)報(bao)酬,這(zhe)是(shi)一(yi)種誤解(jie)。基于(yu)(yu)勞(lao)動(dong)(dong)關系的(de)勞(lao)動(dong)(dong)應(ying)當得(de)到相應(ying)的(de)勞(lao)動(dong)(dong)報(bao)酬,《勞(lao)動(dong)(dong)合同法(fa)》第(di)二十條(tiao)對此明(ming)確規定,“勞(lao)動(dong)(dong)者在(zai)試(shi)用(yong)期(qi)(qi)的(de)工(gong)(gong)資不(bu)得(de)低于(yu)(yu)本單(dan)位(wei)相同崗位(wei)最低檔工(gong)(gong)資或者勞(lao)動(dong)(dong)合同約定工(gong)(gong)資的(de)百分(fen)之八十,并不(bu)得(de)低于(yu)(yu)用(yong)人單(dan)位(wei)所在(zai)地的(de)最低工(gong)(gong)資標準(zhun)”。這(zhe)意(yi)味(wei)著,今后用(yong)人單(dan)位(wei)不(bu)能再讓應(ying)屆畢(bi)業(ye)(ye)生(sheng)做(zuo)廉價勞(lao)動(dong)(dong)力;而畢(bi)業(ye)(ye)生(sheng)也(ye)可以(yi)(yi)(yi)依(yi)法(fa)維護自(zi)己在(zai)試(shi)用(yong)期(qi)(qi)應(ying)得(de)的(de)勞(lao)動(dong)(dong)報(bao)酬。

  問(wen)題七(qi):用人單位在哪(na)些情況下,才可以約(yue)定(ding)違約(yue)金?

  用(yong)人(ren)單位(wei)利用(yong)其優勢地(di)位(wei),常(chang)常(chang)預先在(zai)勞(lao)動(dong)(dong)合同中設(she)定高額違(wei)(wei)約(yue)金,限(xian)制勞(lao)動(dong)(dong)者在(zai)職業上(shang)的(de)(de)自由流動(dong)(dong),也侵害了(le)勞(lao)動(dong)(dong)者的(de)(de)擇(ze)業自主(zhu)權(quan),并由此引發大量勞(lao)動(dong)(dong)爭(zheng)議(yi)。《勞(lao)動(dong)(dong)合同法(fa)》對違(wei)(wei)約(yue)金條(tiao)款(kuan)給予了(le)嚴格的(de)(de)限(xian)制,明確規定只有兩類勞(lao)動(dong)(dong)者可以在(zai)勞(lao)動(dong)(dong)合同中約(yue)定違(wei)(wei)約(yue)金。

  一是用(yong)人單(dan)位(wei)為勞動(dong)者提供(gong)專(zhuan)項培(pei)訓費用(yong),對其進行專(zhuan)業技(ji)術(shu)培(pei)訓的,可以與該勞動(dong)者訂(ding)立協議,約定服務期(qi)。如(ru)果勞動(dong)者違反(fan)服務期(qi)約定的,應當按照約定向用(yong)人單(dan)位(wei)支(zhi)付違約金。但違約金的數額(e)不得超過用(yong)人單(dan)位(wei)提供(gong)的培(pei)訓費用(yong)。

  二是對負有(you)(you)保守商業秘密和知識產權義(yi)(yi)務的(de)高(gao)級管理人員(yuan)、高(gao)級技(ji)術人員(yuan)和其他負有(you)(you)保密義(yi)(yi)務的(de)人員(yuan),用(yong)人單(dan)位可以與之約(yue)(yue)定(ding)(ding)競(jing)業限制,如勞動(dong)者違(wei)反競(jing)業限制的(de)約(yue)(yue)定(ding)(ding),應當(dang)按(an)照(zhao)約(yue)(yue)定(ding)(ding)支付違(wei)約(yue)(yue)金。

  除這兩類勞動者外,用人單位不得與勞動者約定由勞動者承擔違約金。這也是《勞動合同法》的一大亮點。
